Lew Rockwell and Rod Dreher on Lindsay Lohan

The former laments that "a petty bureaucrat in a black robe is putting Lindsey Lohan in a filthy cage for three months, with three-months of further ownership, for the crime of… actually, no crime" — Her Honor — and the latter rejoices, exculpating himself by saying, "It is no bad thing to take pleasure in seeing justice done" — I'm happy that Lindsay Lohan is going to jail.

I would be a joy to see most of the Hollywood sho-biz dopes chained to a leaky barge, floated to the middle of the filthiest part of the Ganges River, and then to watch that barge sink to the bottom.

I know next to nothing about Lindsy Lohan other than that she was in a nice remake of the Parent Trap based on the book Lottie and Lisa.

But as to the comment that drunk driving is a "non crime": Just as running a stoplight is a crime, so likewise is drunk driving. They fall under the fifth commandment.

Reckless driving, drunk or sober, may be a crime, but cautious, responsible drunk driving... I'm not so sure.

Sometimes it's a tough call. Somewhat like using protection, i.e. being cautious and responsible, while rock climbing high on LSD.

The case has been made that drunk driving laws prevent people from driving 10 miles per hour on the side of the road. Instead, they attempt to appear to be sober by driving 45 miles per hour when they really shouldn't.

Tough cases don't disprove the rule, but show that prudence should be used when applying the law.

Writing that driving while drunk is a "non crime" is the same type of universal as applying the law without qualification which as your example shows is imprudent.
